Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Apex Funding Network LLC ("Apex," "Apex Funding Network," "we," "us," or "our") websites, funnels, educational materials, digital products, courses, membership areas, forms, funding-related resources, and related services.
By accessing or using an Apex website or service, creating an account, submitting information, or purchasing a product or service, you agree to these Terms and any additional policies applicable to the particular product or service.
If you do not agree to these Terms, do not use the applicable Apex service or purchase the applicable product.
1 : Educational Purpose
Apex provides information, tools, and educational resources concerning business credit, business funding, funding readiness, business financing, business organization, entrepreneurship, business growth, financial documentation and preparation, and related subjects.
Apex materials are provided for general educational and informational purposes. Nothing provided by Apex constitutes individualized legal, tax, accounting, investment, or financial advice. Users should consult appropriately qualified professionals when individualized professional advice is required.
2 : Apex Is Not a Lender
Apex Funding Network LLC is not a bank, lender, or financial institution and does not independently approve or deny financing applications.
Apex may provide education concerning financing and may introduce, refer, connect, or route businesses to independent third-party lenders, funding companies, brokers, marketplaces, referral partners, or other providers.
All funding decisions, eligibility requirements, approval criteria, rates, fees, amounts, repayment terms, collateral requirements, guarantees, and other conditions are determined by the applicable independent provider.
3 : No Guarantee of Funding or Results
Using an Apex website, purchasing an Apex product, completing an educational program, using the Apex Roadmap, completing a checklist or quiz, submitting a funding inquiry, or communicating with Apex does not guarantee funding approval, eligibility for financing, a particular funding amount, a particular interest rate or financing cost, a particular credit limit, improvement in business or personal credit, improvement in a business credit score or rating, increased revenue, increased profitability, business growth, business success, or any particular financial result.
Individual circumstances and results vary.
Educational progress, checklist completion, quiz results, roadmap stages, or similar features should not be interpreted as a lender's underwriting decision, credit decision, funding-readiness certification, or guarantee of financing.
4 : Digital Products and Educational Programs
Apex may sell or provide digital products and educational programs, including checklists, toolkits, guides, templates, worksheets, courses, Blueprints, resource libraries, memberships, and related materials.
Product descriptions will identify the applicable content, access, price, and other material terms.
A purchase provides only the access or license specifically associated with the purchased product. Unless expressly stated otherwise, purchasing one Apex product does not automatically provide access to every other Apex product, service, membership, or future offering.
5 : Accounts and Access
Certain Apex products or services may require a customer account or login. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Account credentials are intended for the authorized customer and may not be sold, transferred, publicly distributed, or shared for unauthorized use.
Apex may take reasonable steps to restrict or terminate access in cases involving fraud, unauthorized sharing, abuse, chargebacks, refunded transactions, violation of these Terms, or misuse of Apex intellectual property, subject to applicable law and the terms applicable to the purchase.
6 : Intellectual Property and Limited License
Unless otherwise stated, original Apex website content, branding, educational materials, digital products, videos, worksheets, templates, guides, graphics, course materials, and other resources are owned by or licensed to Apex Funding Network LLC and are protected by applicable intellectual-property laws.
When you lawfully obtain an Apex digital product, Apex grants you a limited, revocable where legally permitted, non-exclusive, non-transferable license to use the material for your own internal personal or business educational purposes.
Unless Apex provides written authorization, you may not resell Apex materials, redistribute them as your own product, publish them publicly, share account credentials to provide unauthorized access, reproduce substantial portions for commercial distribution, remove Apex branding or ownership notices for the purpose of presenting Apex material as your own, or use Apex materials to create a competing commercial product through unauthorized copying.
Nothing in these Terms transfers ownership of Apex intellectual property to the customer.
7 : Pricing and Payments
Prices are displayed at or before checkout and may change for future purchases.
By submitting a purchase, you authorize the applicable payment processor to charge the payment method provided for the amount disclosed at checkout.
Applicable taxes, if any, may be added where required.
Payment processing may be performed by an independent third-party payment provider and may also be subject to that provider's terms and policies.
8 : Digital Delivery
Digital products may be delivered by email, download, customer portal, course area, membership area, or another electronic method.
Customers are responsible for providing accurate contact information and maintaining reasonable access to the email address or account used for the purchase.
If you experience a legitimate access or delivery problem, contact Apex support so we can attempt to resolve the issue.
9 : Refunds, Final Sales, and Chargebacks
Purchases are subject to the refund, cancellation, and final-sale terms disclosed for the applicable product and to the Apex Digital Product Refund & Final Sale Policy, where applicable.
Nothing in these Terms eliminates rights that cannot legally be waived under applicable law.
Customers should contact Apex regarding a billing or product-access issue before initiating a payment dispute so that Apex has a reasonable opportunity to investigate and address the matter.
Apex reserves the right, where permitted by law and applicable payment-provider rules, to suspend or remove access associated with a refunded, reversed, fraudulent, or successfully disputed transaction.
Initiating a payment dispute does not itself determine the legal merits of a claim, and Apex reserves all rights to respond to disputes with relevant transaction and access records.
10 : Memberships and Recurring Subscriptions
If Apex offers a recurring membership or subscription, the price, billing frequency, renewal terms, cancellation method, and material subscription conditions will be disclosed before enrollment.
By enrolling in a recurring subscription, you authorize recurring charges according to the terms presented at checkout until the subscription is canceled in accordance with the applicable cancellation terms.
Cancellation generally stops future renewal charges and does not automatically create a right to a refund for a prior billing period unless required by applicable law or expressly provided by the applicable offer.
Any membership-specific terms presented at enrollment are incorporated into these Terms.
11 : User Responsibilities
Users are responsible for providing accurate information, reviewing educational materials and funding information carefully, evaluating whether a product or financing option is appropriate for their circumstances, reviewing financing agreements before accepting them, protecting account credentials, using Apex resources lawfully, and seeking qualified professional advice when appropriate.
Users should not submit false, misleading, fraudulent, or unauthorized information through Apex forms or funding processes.
12 : Third-Party Funding Providers and Services
Apex may provide access, referrals, introductions, links, or technology connections to independently operated third-party companies.
Apex does not control independent third parties and is not responsible for their underwriting decisions, approval or denial decisions, rates, fees, financing terms, products or services, customer service, privacy practices, contractual terms, representations, or performance.
Customers should independently review third-party terms and disclosures before entering into an agreement.
13 : Affiliate and Referral Relationships
Certain links, recommendations, referrals, or services may involve affiliate or referral relationships.
Apex may receive compensation when a visitor or customer purchases, enrolls in, applies for, receives funding through, or otherwise uses certain third-party products or services, where permitted.
Compensation does not guarantee that a particular third-party product or service is suitable for every business and does not control an independent funding provider's approval decision.

14 : Website and Service Availability
We work to maintain our websites, customer areas, and digital services, but we do not guarantee uninterrupted or error-free availability.
Access may occasionally be interrupted for maintenance, updates, technical issues, third-party outages, security reasons, or circumstances outside our reasonable control.
15 : Prohibited Use
You may not use Apex websites, products, accounts, or services to engage in fraud or unlawful activity, submit information you are not authorized to provide, attempt unauthorized access to systems or accounts, interfere with website or platform security, distribute malicious software, misuse Apex intellectual property, resell or redistribute protected Apex materials without authorization, impersonate another person or business, or use Apex services in violation of applicable law.
16 : Disclaimers
To the extent permitted by applicable law, Apex websites, educational materials, digital products, and related services are provided for informational and educational purposes without guarantees concerning individual business, credit, funding, or financial outcomes.
Nothing on an Apex website should replace appropriate professional advice or a user's independent review of a financing agreement.

17 : Changes to Products and Services
Apex may update, improve, replace, reorganize, or discontinue website features, educational resources, or services from time to time.
Material changes affecting a paid product or recurring service will be handled in accordance with applicable law and any terms specifically associated with that product or service.
18 : Changes to These Terms
We may update these Terms periodically to reflect changes in our services, technology, policies, or legal requirements.
Updated Terms will be published with a revised effective date. Where required by law, additional notice or consent will be provided.
Apex Funding Network LLC provides general educational and organizational information. Apex is not a lender and does not make credit or funding decisions. These materials are not legal, tax, accounting, investment, credit-repair or individualized financial advice. Business credit and financing outcomes vary. Third-party providers independently determine eligibility, underwriting, reporting, pricing, approval and terms. No funding, approval, credit score, tradeline, amount, rate or outcome is guaranteed.
